The mere registering of a company or Internet domain name does not guard against others registering similar names in the same jurisdiction or identical names in other jurisdictions.
An effective way to protect one’s IP is to register the trademark in each jurisdiction in which the business intends to have a presence. We highly recommend the early registration of your IP before your business invests in extensive advertising and other marketing initiatives.
Please note that there is no such thing as a worldwide registration of IP. Instead, one needs to carefully explore the geographical markets in which the operation intends to carry on a business, and thereafter register the IP in those markets. Registration of IP can conveniently occur with one application that will cover the European Union (EU). For countries outside of the EU, registration of IP is best achieved through the Madrid Protocol, whereby one application can be submitted to register IP in a variety of countries that have ratified the Protocol.
